Seamless Pattern Design Terms and Conditions – Mary Hart Design Studio

I believe in keeping things as simple and stress-free as possible! By purchasing a design from MHDS, you agree to the following terms.

​

1. General Usage & Licensing

​

  • Commercial & Personal Use: All purchased designs come with a standard commercial license. You are permitted to use the design for unlimited end-product sales.

  • Uses: You can use this design on fabric, stationery, packaging, wallpaper, etc

  • Copyright: All designs and elements are created and strictly owned by MHDS. Purchasing a design does not transfer copyright.

  • Restrictions: You are not permitted to share, resell, or alter the digital files in any way.

  • Re-use of Elements: MHDS reserves the right to reuse individual motifs or elements in future designs or custom projects.

2. Non-Exclusive vs. Colour Exclusive Designs

​

  • Non-Exclusive Designs: Available on maryhartdesignstudio.com. These can be purchased by multiple businesses.

  • Colour Exclusive Designs: Sold exclusively via our Instagram page. Purchasing this license means you have the exclusive right to that specific colourway. MHDS will not sell your chosen colourway to anyone else, but other colourways of the same design remain available for purchase.

3. Purchasing via Instagram (Colour Exclusives)

​

  • How to Claim: The first person to comment "Claim" along with their chosen colour (e.g., "Claim - Sage Green") secures the exclusivity license.

  • Invoicing: MHDS requires your name, email address, and billing address to issue an invoice.

  • Payment Terms: Payment is required within 24 hours of receiving your invoice. If payment is not made, the design will go to the next claimant. If you need more time, please send a message!

  • Delivery: Files are emailed within 24 hours of payment receipt.

4. File Details & Printing

​

  • Format: Files are sent as a seamless, repeating tile in RGB format, JPEG, at 300 DPI. If you need a different format, send a message!

  • Repeating the Pattern: It is your responsibility to upload the tile and set it to repeat via your chosen printer or manufacturer's website.

  • Colour Disclaimer: Colours will vary between screens and printed fabric and will look different depending on the printer and fabric base you use. I highly recommend ordering a test swatch before placing bulk orders.

  • Printing Errors: MHDS is not responsible for any printing errors made by third-party manufacturers.

5. Customisations & Alterations

​

  • Edits: If you need a design rescaled, a motif removed, or a colour tweaked, please get in touch before purchasing. I will do my best to accommodate you!

  • Commissions: MHDS is available for bespoke projects, including product illustrations, packaging, social media graphics, custom patterns, and branding. Send a DM or email to discuss!

6. Refunds & Returns

​

  • Digital Products: Due to the nature of digital files, once a design has been delivered, it cannot be refunded or exchanged.

  • Exceptions: If payment has been made but the files have not been sent yet, a refund is available upon request. If you encounter any technical issues with your files, please reach out and I will be happy to assist you.
